This Disclaimer applies to information, content, communications, Offers, Discounts, services and materials made available through FlatDeal’s website, mobile applications and other digital channels. It is intended to be read with the FlatDeal Terms of Service, Privacy Policy and Cookie Policy.

The purpose of this Disclaimer is to make clear the nature and limits of FlatDeal’s role, the nature of information presented on the Platform, the responsibility of Users to make informed decisions, and the responsibility of Developers, Builders and Sellers for matters within their control.

1. Nature of FlatDeal

FlatDeal is a digital real estate discovery and transaction-facilitation platform. Depending on a Project, FlatDeal may act as broker, channel partner, marketing partner, referral partner, lead facilitator or transaction facilitator.

2. FlatDeal Is Not Ordinarily the Seller

Except where expressly stated otherwise, FlatDeal is not the owner, developer, builder, promoter, seller, lessor, lender or other principal contracting party for a Property displayed through the Platform.

3. Commission and Commercial Relationships

FlatDeal may receive commission, brokerage, referral fees, marketing consideration or other commercial consideration from Developers, Builders or Sellers. Such consideration does not by itself constitute a guarantee that the underlying Property or Developer performance is suitable, secure or successful.

4. Property Information

Information may originate from Developers, Builders, Sellers, channel partners, service providers or public sources. FlatDeal seeks accuracy but cannot guarantee that every item is independently verified, continuously current or free from error.

5. Prices

Displayed prices are subject to change and should not be treated as an unconditional offer by FlatDeal to sell a Property. Final pricing is determined by the relevant Developer, Builder or Seller.

6. Inventory

Displayed inventory may change without notice. A Project page, search result, enquiry, quotation or site visit does not reserve a Property unless expressly confirmed by the relevant Developer.

7. Specifications and Area

Specifications, dimensions, carpet areas, built-up areas and other technical descriptions should be confirmed from approved and contractual documentation.

8. Images and Renders

Photographs, renders, videos, floor plans, illustrations and maps may be representative or indicative and may differ from the final delivered Property.

9. Construction and Possession

FlatDeal does not guarantee construction quality, construction progress, possession timelines, promised amenities, specifications, maintenance arrangements or final delivery by a Developer.

10. Title and Approvals

FlatDeal does not provide an independent guarantee of title, ownership, encumbrances, project approvals, registration, land use, sanctioned plans or legal status unless expressly stated in a separate written professional engagement.

11. Due Diligence

Users must independently verify material legal, technical and commercial matters before committing and should seek independent professional advice where appropriate.

12. Professional Advice

FlatDeal’s general guidance is not legal, tax, accounting, financial, investment, valuation, architectural or engineering advice unless expressly provided under a separate written professional engagement.

13. Investment Returns

No information on the Platform should be treated as a guarantee of appreciation, rental yield, resale value, liquidity, capital protection, profitability or investment return.

14. Financing

FlatDeal does not guarantee loan, mortgage or financing approval. Financing depends on the lender, User eligibility, documentation, Property and applicable lending criteria.

15. Offers and Discounts

Offers and Discounts are available only subject to their specific conditions. They may be Project-specific, unit-specific, inventory-limited or time-limited.

16. Offer Cancellation

If the underlying Booking is cancelled, rejected, rescinded or otherwise does not complete, any associated Offer or Discount may be cancelled or reversed in accordance with the applicable terms and law.

17. Site Visits

Site visits are generally provided without a separate fee unless otherwise stated. A visit is not a legal, technical or financial certification of the Property.

18. Third-Party Performance

The Developer, Builder, Seller or other Third Party remains responsible for its own contractual and statutory obligations. FlatDeal may assist in communication but does not assume those obligations.

19. User Decisions

The decision to enquire, visit, negotiate, book, purchase, lease, finance or invest is made by the User. Platform content is intended to assist, not replace, personal judgment or professional advice.

20. Errors and Corrections

Data-entry errors, outdated feeds, integration errors, pricing errors or other mistakes can occur. FlatDeal may correct or remove inaccurate content and update offers or inventory.

21. Platform Availability

The Platform may be unavailable because of maintenance, technical failures, cyber incidents, telecommunications failures, third-party outages, natural events, government actions or other circumstances beyond FlatDeal’s reasonable control.

22. Third-Party Links and Services

Third-party links or integrations may be subject to independent terms and privacy practices. FlatDeal does not control all third-party systems.

23. No Unqualified Warranty

To the maximum extent permitted by law, information and services are provided on an “as available” basis without a general warranty that every item is complete, current, error-free or suitable for a particular objective.

24. Mandatory Legal Rights

Nothing in this Disclaimer is intended to exclude or limit a consumer right, statutory remedy or legal responsibility that cannot lawfully be excluded or limited.

25. Allocation of Responsibility

The allocation of responsibility described in this Disclaimer is intended to distinguish Platform facilitation from matters controlled by third parties. FlatDeal is responsible for the services it actually undertakes to provide, subject to applicable law. The relevant Developer, Builder or Seller remains responsible for the Property and the contractual or statutory obligations that attach to that party. The User remains responsible for evaluating whether a transaction is appropriate for the User’s circumstances.

26. Detailed Allocation of Risk and Responsibility

FlatDeal-controlled matters

FlatDeal is responsible for the Platform services it actually undertakes to provide, subject to the Terms of Service, technical limitations and applicable law.

Developer-controlled matters

The Developer, Builder or Seller is responsible for the Property, title, construction, approvals, project execution, possession, contractual performance and refunds within that party’s control.

User-controlled matters

The User is responsible for evaluating the Property, supplying accurate information, reviewing transaction documents, obtaining independent advice where appropriate, making payments to the authorised recipient and deciding whether to proceed.

Third-party provider matters

A third party providing a reward, communication, technical or other service remains responsible for its own service to the extent provided under its contract or applicable law.

27. Detailed Price and Offer Disclaimer

A displayed price, discount or promotional statement may be based on information supplied by a Developer, Builder or partner, may be subject to inventory, unit, configuration, payment or time conditions, and may not include every charge associated with the transaction.

Before committing, the User should obtain written confirmation of the applicable price, inclusions, exclusions, taxes, charges, payment schedule and Offer or Discount conditions from the relevant contracting party and review the booking documents.

28. Detailed Transaction Disclaimer

FlatDeal may facilitate a Booking but does not guarantee that the Developer will accept an application, keep a unit available, honour a quoted price, complete construction, deliver possession, perform promised amenities, process a refund within a particular period or comply with every statement made in marketing material.

Where FlatDeal itself makes a written commitment in its own name, that commitment is governed by the document containing it and cannot be expanded by implication from general Platform content.

29. No Reliance on Platform as Sole Source

The Platform is one source of information and assistance. A User should not treat a Project page, marketing copy, recommendation, photograph, video, floor plan or conversation with a FlatDeal representative as the sole basis for a material legal or financial decision.

Primary documents, regulatory records, executed agreements and independent professional advice should be used where appropriate.

30. No Guarantee of Regulatory or Legal Status

Unless expressly stated and supported by the relevant source or document, FlatDeal does not provide an independent legal opinion that a Project has every approval, registration, licence, consent or permission required for the User’s intended transaction. Users should verify material regulatory status through appropriate official or contractual sources.

31. No Agency Beyond Express Authority

FlatDeal’s role may vary by Project. A User must not assume that a FlatDeal employee or representative has authority to bind a Developer, Builder or Seller unless that authority is expressly communicated or evident from the applicable documentation.

Similarly, a Developer’s employee or channel representative does not automatically have authority to bind FlatDeal beyond the authority actually granted.

32. Promotions, Discounts and Benefits

Promotions, Rewards and Discounts are subject to specific eligibility and fulfilment conditions. A benefit advertised in relation to one Project or unit does not automatically apply to another. Availability may be limited by inventory, time, supplier capacity, transaction amount or other conditions.

Unless expressly stated, benefits cannot be combined, converted into cash or transferred. Cancellation of the underlying Booking may cancel the associated benefit.
